My report of storm sewer success -may have been a bit premature.
At the time of the ”reported” success, I understood we were on the final stage of the project and a very short path to completion. All that was outstanding was to tie in one other small severed orphaned clay line – and that could be done by a plumber, through connecting to the new line that now connected to the manhole. I advised Butler Construction to proceed pursuant to coordinating with the City.
Butler followed up with City to request approval/assistance in removing some additional pavement … so this line could be exposed enough to provide plumber space to work. .
City was helpful in making this happen.
This was also where the short path to success……. required a detour.
Apparently what was understood to be a small clay pipe, was actually another large line (12” )that had been severed from the city storm sewer system at some earlier date. I understand that this line carries roof storm water flow from Larry Watt’s building, and part of the flow from Stuart Agnor’s building.
Butler advises that due to the 12” size of the line and related flows of both lines– it is too large to tie into the existing (new) piping connected to the manhole --- and will require being connected directly to the manhole, requiring another “boring” (coring? ) of the manhole.
Concurrent to my email, Todd Butler is contacting Chris Miles to discuss how to proceed. I have cc’d Stuart and Larry to keep them in the loop, as the line involves evacuating flows from both of their properties.
Even with this detour, I remain hopeful success is near.

Diane Solomon called Ned Dennis office for her husband Attorney Vernard Solomon and was told that the “TERM & ADOPT - Signed Father's Affidavit” was not filed because my Son is still in transition from staying with my mother to moving with his mother in Dallas Texas. Mr. Vernard Solomon and his wife have always been great people in my eyes, however, time is passing and he has stopped handling any cases regarding family law.
I called my mother and inquired if things had changed or if Jim was still adopting little Larry, she explained that as far as she knew nothing changed. She stated she was also confused why the papers were not filed as of yet.
The only reason I was aware that Mr. Dennis had not concluded the matter is the attached letter I received from the Attorney Generals Office which prompted my looking into the matter.
1 year ago was a very low point for me in my life in every aspect and I understand many of the decisions I made were not sound, including addressing a matter as serious as this without legal representation. I need help from an attorney to review the matter to determine what is actually transpiring.

Hey Larry, if the Company has a 401k set up with Morgan Stanley, you will need to go thru them. We could do a regular IRA for you, but you should take advantage of the 401k. Contributions will come out of your pay check pre-tax and most of the time employers will match up to a certain percent of your contribution, unlike with a regular IRA.
If later down the road you are no longer with the company, let me know. If you separate from employment, I can be your financial advisor on the account and reclassify it as an traditional IRA.

This is an update primarily for the east side of the 300 block of N Washington but I wanted to include everyone. As most if not all of you are aware the work on the streetscape project over the

This is an update primarily for the east side of the 300 block of N Washington but I wanted to include everyone. As most if not all of you are aware the work on the streetscape project over the last two weeks has stalled due to issues discovered primarily at the southeast corner with the brick façade and some concerns over the existing stormwater pipe along the east and west sides. We were able to verify that the existing storm pipes along the east side going south are intact and functioning and they will remain in place. However the west side stormwater piping which is hand laid brick piping in excess of 100 years old will need to be replaced. I will need to bring this change in the scope of the project to the City Council for their review and approval in accordance with City policy. I plan on presenting this at the March 7th meeting. We are still working out the details for the brick façade and we should have a scope and plan within the next week or so and get that piece moving forward.
That being said the crew installing the stormwater on the east side from the inlet box going north started today and will continue tomorrow. Also the same crew will be relocating water meters in the same area starting tomorrow morning around 7:30am. This will result in a short term disruption in water service, perhaps 30 minutes or so while the meter is relocated closer to the street (see the 200 block as a reference, blue colored lid) and most likely will cause some air in the lines and maybe a slight discoloration. Running your faucet or flushing a toilet will clean that up.
Moving forward I will be working with the contractor to develop a two-week schedule of work and provide to the group so that all of you can have a sense of when things are scheduled to happen especially when they occur directly in front of your location. I am hoping to have that sometime next week as well and will send it out via email.

*Everyone agrees the end product will be beautiful and much needed
*Retail is in dire straits. They are seeing a DRASTIC reduction in revenue from January 23 compared to January 24. It is a real struggle to maintain business. Even with a business that does not have traditional retail, the reduction in walk in traffic has all but halted. This is an emergency situation for businesses.
*The major concern is on days when there are no workers present, the streets are remaining barricaded and closed. The retailers have hard data that shows as soon as streets are opened that business resumes.
*Another major concern is the lack of communication from construction workers of anything major that will be happening that will directly affect their business. It is requested that everyone know of the work that will be done so business hours can be altered if needed.
*Eric Powell addressed most questions. He stated that it is projected that the end of March of at latest the end of April, that sidewalks will be available at least to part of the block. There is a structural issue that is being discussed on a couple of buildings on the east side and it is possible those sidewalks will not be completed at the same time. Sidewalk forms should be starting to be laid as early as this week.
*E Powell said that there has been a financial adjustment that had to be made based on some "surprise" finds, etc. He stated as soon as the City Commission approves the change the work on that particular thing (I believe the pouring of concrete) will begin the following day. That item is on the agenda for 3/7. Work should begin pending approval on 3/8. He stated that a special called meeting would not be possible on this in efforts to move the work up.
*In reference to trash pick up: E Powell is contacting Republic Waste to let them know that canisters will be placed on the corners for pick up. So, take the canister to the closest corner.
*E Powell said that he has talked with the supervisor of construction, Carl. If construction workers are not present by 10:00 AM, please contact Carl and let him know. It has been agreed that is workers are not there by 10 the streets are to be opened for business for the rest of the day. Eric is going to pass on Carl's contact information.
*Lacy Burson with Main Street, has ordered signage to put at the end of the streets at each barricade. The signs will state that businesses are open, etc.
*Property owners are brainstorming on ways to bring attention and business in the area with possible promos.
*Raven Lenz, representing Main Street but also merchant, suggested that merchants bring balloons, etc to draw attention to their open businesses although people cannot drive up the street.
*Several people are looking into sources of financial relief for lost revenue from merchants due to the construction.
*R Lenz also reported that KMHT has GRACIOUSLY agreed to promote downtown merchants and that they are open for shopping.

· Old lead service line removed by City crews around mid-block.
Upcoming week:
· Contractor crew will be on site Monday to work on the stormwater box mid-block of eastside.
· Sidewalk crews may be on site mid-week to begin formwork install for the concrete sidewalk.
· City crews will be on site Monday morning testing water valves to isolate the watermain so the fire hydrant at Burleson can be removed later in the week. There may be a temporary loss of water as crews test the valves.
· Provided the valves operate properly City crews will be on site first thing Wednesday (3\6) to excavate and remove the old hydrant and leaking valve at the corner of Burleson. The work should take 3 or 4 hours provided there are no other problems that arise.
Future items:
· The change order for the upgraded stormwater pipe on the west side of the 300 block is schedule to be heard and hopefully approved at the Council meeting next Thursday evening, March 7.
· Once approved, crews with Casey Slone can begin the removal of the old brick pipe and the installation of the new storm pipe as early as Friday March 8.

Good evening.
I have included everyone that was invited to the Neighborhood Meeting on yesterday as well as retail merchants in the 300 block of N Washington that I had contact information for in this email. The meeting held yesterday included City personnel, property owners in the 300 block of N Washington, and committee chairs from boards that have vested interest in the advancement of downtown Marshall. I will recap the meeting for everyone.
*Everyone agrees the end product will be beautiful and much needed
*Retail is in dire straits. They are seeing a DRASTIC reduction in revenue from January 23 compared to January 24. It is a real struggle to maintain business. Even with a business that does not have traditional retail, the reduction in walk in traffic has all but halted. This is an emergency situation for businesses.
*The major concern is on days when there are no workers present, the streets are remaining barricaded and closed. The retailers have hard data that shows as soon as streets are opened that business resumes.
*Another major concern is the lack of communication from construction workers of anything major that will be happening that will directly affect their business. It is requested that everyone know of the work that will be done so business hours can be altered if needed.
*Eric Powell addressed most questions. He stated that it is projected that the end of March of at latest the end of April, that sidewalks will be available at least to part of the block. There is a structural issue that is being discussed on a couple of buildings on the east side and it is possible those sidewalks will not be completed at the same time. Sidewalk forms should be starting to be laid as early as this week.
*E Powell said that there has been a financial adjustment that had to be made based on some "surprise" finds, etc. He stated as soon as the City Commission approves the change the work on that particular thing (I believe the pouring of concrete) will begin the following day. That item is on the agenda for 3/7. Work should begin pending approval on 3/8. He stated that a special called meeting would not be possible on this in efforts to move the work up.
*In reference to trash pick up: E Powell is contacting Republic Waste to let them know that canisters will be placed on the corners for pick up. So, take the canister to the closest corner.
*E Powell said that he has talked with the supervisor of construction, Carl. If construction workers are not present by 10:00 AM, please contact Carl and let him know. It has been agreed that is workers are not there by 10 the streets are to be opened for business for the rest of the day. Eric is going to pass on Carl's contact information.
*Lacy Burson with Main Street, has ordered signage to put at the end of the streets at each barricade. The signs will state that businesses are open, etc.
*Property owners are brainstorming on ways to bring attention and business in the area with possible promos.
*Raven Lenz, representing Main Street but also merchant, suggested that merchants bring balloons, etc to draw attention to their open businesses although people cannot drive up the street.
*Several people are looking into sources of financial relief for lost revenue from merchants due to the construction.
*R Lenz also reported that KMHT has GRACIOUSLY agreed to promote downtown merchants and that they are open for shopping.

· Pending any additional rain over the weekend the contractors crews will move back in to the project site on Monday. Work will include the forming for the sidewalks, curbs, and gutters along the east side as well as work needing to be done on the two inlet boxes located on the east side.

I expressed my concerns, to the contractors removing the sidewalks, about water run off during the sidewalk removal and was assured it was under control.
Sunday, February 11, 2024 at approximately 8:00 am the finished lower level in our building flooded with mud and water from the front area where the sidewalk was removed. I stood the walk boards up Infront of the area the water was entering to attempt to divert the water from further rushing in our building. I called a friend who brought sump pumps and I purchased a larger one from Tractor Supply and had 3 of them running to minimize the depth and damage in our building. We sucked water and mud out of the building with shop vacs and sump pumps until 11 PM.
Review of the street clearly exhibits we were the low point and there were obstructions in the drainage system caused by the construction work.
Monday, February 12, 2024 I called the City and was referred to “Public Works Director” Eric Powell @ 903-935-4487 who advised he would contact the job foreman and have them follow up with me.
Wednesday, February 13, 2024 I approach the foreman and inquired if he had been advised of the situation. I expressed my concerns about additional rain in the forecast. The foreman acted unaware of the situation and advised he would see what he could do.
Wednesday, February 13, 2024 I noted 3 Ultratech “Ultra-Filter Socks” laid on the ground in front of the opening were the water entered our building.
Per the manufacture website, some of the product highlights include: “Woven polymer casing allows water to pass through quickly while filtration media inside removes pollutants.” This product is designed to filter contaminants out of water, not to prevent water passing through, in fact they are specifically designed to allow water to pass through. When I discussed my concerns about this with the foreman he indicated that is why he utilized 3 of them and he assured they would work. I politely expressed my continued concerns.
Thursday, February 15, 2024 I noted some dirt had been graded
1) HVAC inside 10 ton air handler and return got flooded with the mud and water, including the filters, insulation, motor and fan.
a. Minimum Repairs:
i. Return insulation and handling insulation will need to be
replaced.
ii. Motor and fan will need to be replaced.
iii. Unit will need to be cleaned.
2) Emergency cleanup was performed, additional cleanup is needed.
3) Disposal of damaged items is needed.
4) Purchased $3??.?? Sump pump from tractor supply to utilize along with 2 borrowed sump pumps to drain the basement as it was feeling to prevent further damage.

I've spoken with Carl about my concerns regarding grading dirt up against the front floor joists. In addition to that, I'm worried about potential moisture issues that could arise from the new concrete pour.

Friday, February 16, 2024 I installed sand bags, covered them with plastic and placed dirt over the plastic. Since then I have installed sand bags over the dirt to prevent it from washing away during some of the recent heavy rains that even washed a 4x8 sheet of plywood from the front of our building to the front of the neighbors building.
Issues Created:

Overall another positive week where we saw the completion of the two inlet boxes (forms will be stripped on Monday), additional curb and gutter formwork and concrete installed including the radius on the northeast corner, and the stormwater pipe showed up early so crews were able to begin the installation on the southwest corner heading north. One correction from last week’s update there was no sidewalk poured as the electrician had not had the chance to install conduits on the east side yet.
A look ahead to next week:
· Crews will continue to form curb and gutter going south which will include the radius on the southeast corner.
· Electricians will be onsite to begin installing the electrical conduit on the east and west sides
· Installation of the stormwater pipe will continue on the west side going north. · Pouring of more curb and gutter with a slight chance of sidewalks by weeks end (depends on electrical conduit progress).

Dear Eric and fellow sufferers of the downtown renovation project:
We have been having issues with boards placed in front of our entrance that rock and roll when you step on them. Yesterday, my new executive assistant was approaching the entrance to the office. She hesitated and some of the workers said they would lay a board down for her. They laid down two 2 x 4’s across the cavernous hole in front of our office.
Looking at the “bridge” she said, “I hope I don’t fall”. They replied, “We do too. Because if you do, we can’t help you.” What they should done is instructed her how to go to the end of the block and work her way back through the maze of dirt and wobbly boards. What an inappropriate and unprofessional thing to say.
I have frequently had my webinars which are 75% of my income drowned out (despite my headset) by backhoes working directly in front of my door. When I ask them to do something else for awhile, they stare at me blankly, laugh, and keep working.
I have finally recovered from the serious fall and injury to my foot (bruised top and bottom with a probably broken bone) that occurred several weeks ago. The supervisor (the old guy in the white truck) who was right beside me when I fell, looked out the window and said “are you all right” and made no attempt to help me up. I am 75 years old by the way.
My parents were from 1946 – 1990 commercial builders (hospitals, schools, libraries, etc.) in South Dakota and would never have treated people affected by their work in this manner. I guess people in South Dakota have better manners than people in East Texas.

Subject: Friday Update - 3/15/2024
This is the Friday update for the 300\400 block of N Washington Streetscape project:
As all of you are well aware the project has ground to a halt with no significant work being done for the last two weeks or so due to some pretty significant issues that needed to be worked through as well as weather. As of the date of this email most of those issues have been resolved or dealt with which will allow the project to restart and barring any other unforeseen issues stay on track and on schedule.
With that being said here is the update for the previous week and a two week look ahead to scheduled activities.
Previous week:
City crews were able to isolate the old hydrant last Sunday (3/10/2024) morning and remove it from the work area which will allow the continued forming of the sidewalk. Change Order #1 was approved at the Council Meeting on Thursday night (3/7/2024) allowing the contractor to begin procuring the materials.
City crews were able to expose the existing storm drain on the southwest corner of the 300 block to verify condition and the connection point for the new storm drain installation.
Two week look ahead:
Stormwater pipe and fittings have been ordered by the contractor and are scheduled to ship on 3/29/2024 with estimated arrival at the job site within 5 days (on or about April 4th or 5th).
Pending any additional rain over the weekend the contractors crews will move back in to the project site on Monday. Work will include the forming for the sidewalks, curbs, and gutters along the east side as well as work needing to be done on the two inlet boxes located on the east side.
As always these schedules are subject to weather conditions but hopefully the project can get a restart and move in a positive and forward direction. As always if there are any questions please feel free to call or email me and I will get you answers as soon as I can. Thank you.

I was there at 9 30 this morning and only 3 guys pumping some water. Not one worker working on the side walks. Said they was waiting on a electrician to put conduit in. The conduit has been sitting there for a week. It takes 2 hours to glue it together and lay it in the forms. Perfectly sunny dry day and no progress. This project is a stain on the city of marshall in my eyes and a very sad thing to see that no one care enough about the business that are being affected. And words mean nothing, action does. Accountability does. If no one gets fired for this disaster then it shows how corrupt it is. And what's sad is this same contractor will have the next city job. And this is coming from someone who ain't affected by it to the extreme that some of my neighbors are that's been there for 30 year and may lose there lively hood. What do you have at the end, if you have a pretty side walk but have killed the business and ran off the investors?

That would be a good idea. Once the clean out is installed at the property line we can than wash out toward the street. A two way clean out is recommended so it can be washed out both ways.

We have taken immediate action by cleaning up the mess, installing two fans, turning off the water supply and informing the tenants that the plumbing will remain inoperative throughout the evening and likely into tomorrow.

Good Evening Mr. Powell,
I have encountered a situation that may end up affecting others on the block as well.
I have been at 303 N. Washington Avenue since March 22, 1999, without any prior issues concerning the sewage drainage system. However, today, April 7, 2024, upon the return of the upstairs tenants to their apartments, the usage of water for showers and other purposes has seemingly exposed a disruption in the drainage of wastewater and sewage into the city’s sewer system.
As a consequence, there has been an overflow of water and sewage from the front office's toilet, originating from the upstairs apartments. This suggests a potential issue with the wastewater drain pipe in front of our building. Notably, the toilet in question has not been used since Thursday when Gwenn was in her office, and it was not obstructed or backed up at that time. Hence, it is logical to deduce that the obstruction lies either in front of the building or further down the line.
We have taken immediate action by cleaning up the mess, installing two fans, turning off the water supply and informing the tenants that the plumbing will remain inoperative throughout the evening and likely into tomorrow.
Do you have access to a scope, or what is your recommendation from here?

My message was probably confusing. They are not able to inspect their line outside of our building, only the main sewer line. They said I’d have to install a clean out for them outside of our building for them to inspect their line? I offered them access to the inside clean out to be able to inspect their line. They advised it’s against the rules. So I should start digging…?

If your plumber found a break\issue with the service line beyond the property line than my crews can make that repair as that would be the City side of the service. Obviously with the current weather we are experiencing that most likely will need to be sometime tomorrow if we can get a respite in the rain. Based on looking at the Harrison County Appraisal District it looks like the property line is very close to the front of the building. If your plumber provide you with a distance from the building to the break please provide that so we can pinpoint the location.
As far as filing any claim against the City or the contractor those would be separate filings, one with the City and one against the contractor. If you choose to file a claim against the city you would need to contact Kristina Hamilton at City Hall, 903-935-4447 to start that process.
I will have Mr. Kervin Crawford, Superintendent of Distribution and Collection call in emergency locates and we will make the repair to the service line as soon as it is feasible to get in there which may be as early as tomorrow based on the rain.

Eric did respond yesterday and arranged for a City sewer crew to inspect the main and lateral line.
However, they declined to inspect the lateral line, stating that a cleanout needed to be installed in the front of our building before they would proceed. I explained that we already have a highly accessible cleanout with a direct connection to their pipe inside our building's lower level, which they are more than welcome to utilize. Unfortunately, they insisted that I install a new cleanout in the front of the building before they would review further. I confirmed they had portable equipment that could easily be utilized from our existing cleanout, however, they stated they would not.
I’m a little confused by this, as I’m not sure the city would even approve of me installing a clean out in front of our building, in the new sidewalk.
I was not able to find any plumbers with this equipment that were available yesterday, so I rented what was available, being a 75’, 85’ snake and a 200’ plumbing camera from Longview. We found our 4” drainpipe to be clear until approximately 64-65’ at which point there appears to be something preventing the camera from proceeding further. Unfortunately, the camera goes under water at approximately 50 feet so we are not able to determine what is the cause of the obstruction. We noted that this distance puts the blockage between our building and the city street where the trench was dug for the new storm drainpipes.
I have two plumbers scheduled to come by today, one from Tyler and one from Marshall. The one from Tyler will already be here today for another appointment so he will stop by after his previous appointment. The reason I scheduled two is due to the local plumber’s lack of communication and continued hesitation to even confirm he will arrive today due to rain.

Dear Mr. Powell,
I apologize if my previous emails were not clear.
Once again, I’m attempting to clarify who’s insurance company is responsible for the following;
1. Damage from the flooding event.
2. Damage to the sewer line in front of our building.
3. Damage to the brick facade caused by jackhammers.
Do I need to file separate claims and under who is the correct process? Under the city or under "your" contractor? If under "your" contractor please provide "your" contractors insurance information so that I may proceed. I understand it is supposed to be a public record.
Please understand I also have other responsibilities that are not being met due to these issues not be concluded and resolved.
The location pointed out to me was near the inside of the trench dug for the storm drains.

Dear Mr. Powell,
Thank you for your previous email. I apologize for the delayed reply due to a power outage yesterday afternoon that lasted throughout the evening (April 9th).
If I'm understanding your email correctly, should I be the one filing the claim with the city or the contractor’s insurance company?
If so, please provide the insurance information, including insurance company and policy number, for the contractor so I can file that immediately. I want to be sure to comply with all and any of their requirements, throughout the repair process.

If your plumber found a break\issue with the service line beyond the property line than my crews can make that repair as that would be the City side of the service. Obviously with the current weather we are experiencing that most likely will need to be sometime tomorrow if we can get a respite in the rain. Based on looking at the Harrison County Appraisal District it looks like the property line is very close to the front of the building. If your plumber provide you with a distance from the building to the break please provide that so we can pinpoint the location.
As far as filing any claim against the City or the contractor those would be separate filings, one with the City and one against the contractor. If you choose to file a claim against the city you would need to contact Kristina Hamilton at City Hall, 903-935-4447 to start that process.
I will have Mr. Kervin Crawford, Superintendent of Distribution and Collection call in emergency locates and we will make the repair to the service line as soon as it is feasible to get in there which may be as early as tomorrow based on the rain.
